ii) Govari Limited accepts no obligation for any alleged damages or losses, whether or not the Company or its suppliers were aware that such damages or losses were likely, or whether or not an initial legal action was unsuccessful or is still pending.

iii) The definition of losses and damages differs by state. Some states, for example, ban both the limitation of liability for "incidental and consequential damages" and the deletion of "implicit warranties," thus each party's liability is limited to the level permissible by that state's legislation.

6. Jurisdictional law

i) Except as otherwise indicated, these Terms and the Use of the Service are subject to the laws, rules, and procedures of Cyprus, with the exception of those relating to conflict of laws.

7. Dispute resolution

i) By using the Service, you agree to direct any questions or difficulties to the Company and to first try to settle such issues in good faith.

  • For EU Consumers - EU citizens will be subject to the laws and regulations of the EU country in which they reside.

8. Severability clause

i) If any of the terms or conditions are ruled invalid or unenforceable, the other portions will continue to apply and be enforceable. To guarantee compliance with this Section, revised sections must be reconciled with the rest of the terms/conditions as much as practicable.

9. Waiver for breaches

i) Unless otherwise noted, a Party's failure to comply with the Terms does not bar the Party from exercising such a right or requiring performance in the future. Waiving a breach does not prevent waiving another in the future.

10. Preferred translation

i) If we provide you with a translation of these Terms and Conditions in a language other than English through our Service, you agree that in the case of a dispute, the original English version of these Terms will take precedence.

11. Revisions

i) The Company reserves the right to revise the Terms and Conditions at any moment. If there are significant revisions to the Terms, the Company must tell you at least 30 days before the new Terms take effect. The Company shall have the exclusive discretion to evaluate whether the changes to the Terms represent material changes warranting such notices.

ii) By using or accessing our service after the effective date, you accept the newly amended Terms and agree to abide by them. If you find the amended Terms unfavorable please refraining from using our website and Services moving forward.
